Compliance Matters #6 | Beatriz Saura, Co-President of the Compliance Section of the ICAM | Podcast IE University & Elecnor
In this sixth episode we talked with Beatriz Saura, Co-President of the Compliance Section of the ICAM, to comment on the work done by the Madrid Bar Association in the matter of Compliance.
Our host Enrique Aznar, academic director of the IE-Elecnor Observatory on sustainable compliance and Saura talk about the action ICAM has taken when there was the reform of the penal code in 2015 and how they have adapted to give security to their work and their clients.
At first, Beatriz explains that the reform being a new theme at first created confusion. Moreover, this new approach is very contrary to the Spanish legal system of before, since “it had always been said that the legal person could not commit a crime, and now suddenly, it turns out that they can”.
Right now, the compliance section of ICAM is responsible for helping lawyers through training in compliance. Beatriz also explains that they focus on forming working groups to analyze jurisprudence and make publications.
Enrique and Beatriz also talk about the Compliance Officer, and conclude that the Compliance Officer does not have to be licensed in law, but they must work hand in hand with lawyers, since it is the lawyers who must provide the legal part.
During the episode, they also comment on the difference between compliance adaptation in large companies and SMEs. Since 2015, large companies, especially international ones, have opted for compliance by creating departments to adapt, on the other hand, SMEs have struggled to develop specific departments, mainly due to lack of resources.
Finally, Beatriz reflects on the importance of the internal complaints channel in companies. Since this helps companies really know what’s going on inside them, and if there really is a problem, catch it in time. “Employees who report wrongdoing protect the company,” Saura concludes.
